ORDER DENYING 64 Motion for Sanctions Under Federal Rule of Civil Procedure 11 by ELIZABETH'S STUDIO LLC. On 7/15/2026, Defendants cowgirlelf.com, cowgirlshouse.com, dailycloths.com, everydaly.com, gamedayootd.com, mywesternshop.com, shamrocktshirt.com, texaslocalshop.com, texasqualitywear.com, usafaithwear.com, usarodeotime.com ("Moving Defendants") filed the 45 Motion to Quash Service as deficient and to Dismiss the Complaint for lack of personal jurisdiction. ECF No. 45. After receiving extensions to respond to the motion, see ECF Nos. 55 and 59, Plaintiff Elizabeth's Studio LLC filed on 9/2/2026 the instant 64 Motion for Sanctions, ECF No. 64. Plaintiff moves for sanctions on the grounds that the Moving Defendants' 45 Motion is improper because (1) there is no completed formal service to quash in the first place, and (2) outright dismissal as a remedy for deficient service contravenes binding Third Circuit precedent. See ECF Nos. 64, 65. Plaintiff is correct that "perfecting service on a defendant is not a prerequisite to the entry of a preliminary injunction order." See ECF No. 14 (TRO Order) at 12 n.6. And the Court confirms that formal service of process has not been perfected in this matter as to any defendants. But any misunderstanding of this distinction by Moving Defendants is not a basis for sanctions at this time. The Moving Defendants were not objectively unreasonable in guardedly (though incorrectly) construing Plaintiff's certificate of service, ECF No. 23, as a formal service of process and then challenging such process on the grounds they did, see ECF No. 45, even after Plaintiff's Rule 11 letter, ECF No. 65-1. Moreover, the Court does not read Moving Defendants' 45 Motion as requesting dismissal as a remedy for deficiency in service. See ECF No. 45 at 1, 10. To be sure, Moving Defendants request dismissal of the complaintbut only on the basis of lack of personal jurisdiction, not service deficiencies. See id. ORDER. On 6/12/2026, this Court granted Plaintiffs 4 motion for a temporary restraining order and scheduled a hearing to show cause as to why a preliminary injunction should not be issued on 6/23/2026. ECF No. 14. On 6/22/2026, the Court rescheduled the hearing for 7/7/2026 in light of attorney Chens appearance on behalf of certain Defendants and 17 motion for extension of time to file opposition to preliminary injunction.
