MINUTE entry before the Honorable Robert W. Gettleman: The motion for entry of default and default judgment [29] is denied. Counsel is directed to review this court's Standing Order on Procedures in Schedule A Litigation. There are two issues that preclude the court from entering default judgment. First, the court needs to be assured that it has a proper basis for exercising personal jurisdiction over the remaining defendants. At this stage, plaintiff's allegation "on information and belief" that these defendants have sold infringing products to residents of Illinois is not sufficient. See Liu v. Monthly, 170 F.4th 1090, 1093 (7th Cir. 2026). Second, where the Hague Convention applies, it governs the grant of default judgment. See Volkswagenwerk Aktiengesellschaft v. Schlunk, 486 U.S. 694, 705 (1988) (stating that "compliance with the Convention is mandatory in all cases to which it applies"). If plaintiff wants the court to enter default judgment, then it must explain why the court is authorized to do so under the Hague Convention. The court recognizes that plaintiff has dismissed Chinese-based defendants. Nevertheless, if the remaining defendants are based abroad, the Hague Convention still may apply. Plaintiff assures the court that the remaining defendants are from countries that do not object to email service. That may well be true, but plaintiff has not told the court where these remaining defendants are from. And even if service on the remaining defendants complied with the Hague Convention, plaintiff still must show that the conditions of Article 15 have been met. Counsel is strongly encouraged to review this court's opinion in Santana Tesoro, LLC v. The Partnerships, No. 26 C 1395, 2026 WL 2546903 (N.D. Ill. Aug. 28, 2026) before resubmitting a renewed motion for entry of default and default judgment. Emailed notice
