MINUTE entry before the Honorable Mary M. Rowland: Plaintiff's Motion for a TRO 13 is denied. "For a TRO or preliminary injunction order to be valid, the issuing Court must have personal jurisdiction over the defendants." Am. Bridal & Prom Indus. Ass'n, Inc. v. The Partnerships & Unincorporated Associations Identified on Schedule A, 192 F. Supp. 3d 924, 930 (N.D. Ill. 2016). Even putting aside the issues with service 14, the Court is not convinced that personal jurisdiction has been established. Plaintiff is reminded that personal jurisdiction over an online retailer is not established merely because the retailer's website is available in Illinois. Liu v. Monthly, No. 25-2074, 2026 WL 681773, at *2 (7th Cir. Mar. 9, 2026). Instead, minimum contacts with Illinois are found only where an Illinois customer actually purchased a product from the online retailer and the retailer shipped the product to Illinois. Id.; see also Curry v. Revolution Labs., LLC, 949 F.3d 385, 392-93 (7th Cir. 2020). Plaintiff's motion for a TRO 13 and Complaint 1 do not establish that the Defendants have actually sold and shipped products to residents in Illinois. Mailed notice.

The Declaration of Dilpreet Aujla [15-2] in support of Plaintiff's motion is entirely generic and lacks any substantiated details as to what specific investigative steps were taken with respect to each of the Defendants. Without such details, the Court cannot determine whether Plaintiff's investigation was reasonably diligent enough so as to deem Defendant's addresses unknown and avoid application of the Hague Convention. Kangol LLC v. Hangzhou Chuanyue Silk Imp. & Exp. Co., No. 25-2205, 2026 WL 1502198, at *4 (7th Cir. May 29, 2026). Additionally, while Plaintiff requests service of process by email, Plaintiff does not provide what email addresses it proposed to serve and how it obtained those emails. MINUTE entry before the Honorable Mary M. Rowland: Plaintiff's motion to seal 11 is granted. Plaintiff's motion for electronic service 12 is denied. In Kangol LLC v. Hangzhou Chuanyue Silk Imp. & Exp. Co., 2026 WL 1502198, at *5 (7th Cir. May 29, 2026), the Court found that "[t]he [Hague] Convention's text and structure demonstrate that, where it applies, it provides the permissible means of service and excludes all others. And because no provision of the Convention authorizes service by email in China, such service violates the Convention and Rule 4(f)(3)." The Court grounded its holding in the Convention's exclusivity, concluding that the Convention "creates a closed universe" of permissible service methods. As Plaintiff's motion states that "Fendi has good cause to suspect that the Defendants are all residents of China and/or Hong Kong." [12-1 at 3]. The Court will not consider the motion for TRO until service of the 5 defendants is resolved. Plaintiff shall file a status report or a revised motion by 7/6/26. Mailed notice.
