Chang: By agreement under Internal Operating Procedure 13(d), because of the overlap between the relief sought in this case and in 1:19-cv-02170, In re Ethiopian Airlines ET 302, this case is transferred by consent of the assigned judges to the calendar of Judge Jorge Alonso. The relief sought in this case would declare who has the right to litigate the claims in 1:19-cv-02170, which is already the subject of motion practice in 1:19-cv-02170 (along with two interlocutory appeals). Chang: On review of the motion for alternative service, and on review of the docket in the consolidated case, In re Ethiopian Airlines Flight 302, 1:19-cv-2170, it is not clear why a separate declaratory judgment action is the proper appropriate procedural step to seek the relief sought. The Plaintiffs here seek a declaration that they, not the appointed guardian ad litem in the consolidated case, have the exclusive right to represent the Estate. But that would appear to be a dispute for the judge in the consolidate case to resolve, not a separate judge in a separate case. Indeed, the Plaintiffs appear to be litigating that very dispute in the consolidated case, see 1:19-cv-2170, R. 2858. The notice of motion 8 is vacated for now. Instead, the Plaintiffs shall file a position statement explaining why this case should not be dismissed in favor of pursuing the requested relief in the consolidated case.
