MINUTE ORDER: Before the Court is non-party Charles Muszynski's Motion for Leave to File Amicus Curiae Brief in Support of Defendant Does, ECF No. [9], (the "Motion"). Though not addressed in the Federal Rules of Civil Procedure, this Court has broad discretion to allow participation of amicus curiae. Medina v. Cath. Health Initiatives, No. 13-cv-01249-REB-KLM, 2015 WL 13683647, at *1 (D. Colo. Oct. 7, 2015). However, any contested motion filed in this Court "shall state under which rule or statute it is filed and be supported by a recitation of legal authority in the motion." D.C.COLO.LCivR 7.1(d). This rule applies to Mr. Muszynski even though he appears pro se. E.g., Nielsen v. Price, 17 F.3d 1276, 1277 (10th Cir. 1994); Rucinski v. Torian Plum Condo. Owners Ass'n, Inc., No. 08-cv-02798-WJM-MJW, 2011 WL 1235517, at *2 (D. Colo. Apr. 1, 2011) ("The fact that a party is appearing pro se does not relieve that individual from the obligation of complying with all applicable rules of the court."). Because the motion offers no rule under which it may be granted and cites to no legal authority for the requested relief, the Motion, ECF No. [9], is DENIED. While the movant does mention some cases in his reply, ECF No. [11], they do not save the motion because they do not relate to the relief requested; instead they relate to the arguments put forth in the proposed amicus brief and the movant's new request for an Order to Show Cause, which the Court does not consider because "[a] motion shall not be included in a response or reply to the original motion." D.C.COLO.LCivR 7.1(d). Entered by Magistrate Judge Cyrus Y. Chung on 12/22/2025. Text Only Entry.(agryan)
