TEXT ORDER. No later than November 6, 2026, Plaintiff is directed to SHOW CAUSE as to why the Court should not sever Plaintiff's patent infringement claims into individual cases for each Defendant pursuant to Federal Rule of Civil Procedure 21. 35 U.S.C. section 299 provides that a plaintiff in a patent case may join defendants together in one case under certain circumstances. However, 35 U.S.C. section 299(b) provides that "accused infringers may not be joined in one action as defendants or counterclaim defendants, or have their actions consolidated for trial, based solely on allegations that they each have infringed the patent or patents in suit." Here, Plaintiff claims that each Defendant has infringed its patent by offering separate products for sale. Accordingly, it appears that 35 U.S.C. section 299(b) forbids Plaintiff from litigating its claims through a single case. Should the Court sever the cases, Plaintiff would be required to pay the requisite $350 filing fee for each severed case, which would total approximately $44,800.
