On May 14, 2026, the Court entered an Omnibus Case Management Order, [ECF No. 300], ordering Plaintiffs to conduct informal settlement conferences with various subsets of Defendants and file a joint scheduling report on or before June 30, 2026. On June 30, 2026, Plaintiffs filed an Agreed Motion for One-Week Extension to comply with the Court's Order, noting that "the parties have diligently complied with the Court's order, have successfully resolved this action as to nearly all of the Defendant subsets identified in the Order, and have confidence that claims can be resolved as to additional defendants in the coming week." On May 20, 2026, the Court set aside the Clerk's Entry of Default as to Defendant Lingmou, named as Rapsuar. [ECF No. 305]. The same day, the Court entered a Paperless Order Requiring Responses to Complaint and Informal Settlement Conferences as to Defendants Lingmou (Rapsuar) and Aobosi. [ECF No. 306]. In the Paperless Order, the Court required Lingmou to respond to Plaintiff's Complaint on or before June 3, 2026 and participate in an informal settlement conference with Plaintiffs on or before July 10, 2026. Id. On May 21, 2026, Defendants Lingmou and Velieta jointly filed a Motion to Dismiss. [ECF No. 308]. On May 20, 2026, Defendant Lingmou--named in the Clerk's Entry of Default as "Rapsaur"--filed a Motion to Set Aside Default ("Motion"). See [ECF No. 303]. The Court "may set aside an entry of default for good cause." Fed. R. Civ. P. 55(c). Although good cause is "not susceptible to a precise formula," Courts may consider factors including "whether the default was culpable or willful, whether setting it aside would prejudice the adversary.whether the defaulting party presents a meritorious defense[, and] whether the defaulting party acted promptly to correct the default." Sherrard v. Macy's Sys. & Tech. Inc., 724 F. App'x 736, 738 (11th Cir. 2018) (cleaned up). The Eleventh Circuit has made clear that defaults are disfavored given the "strong policy of determining cases on their merits." Id. (quoting In re Worldwide Web Sys., Inc., 328 F.3d 1291, 1295 (11th Cir. 2003)). Here, Defendant Lingmou has represented credibly that the default was not willful or culpable because "Defendant was unaware that it had been sued under the alias 'Rapsuar' until Plaintiffs filed their Motion for Default Judgment" and "[u]pon discovering the mismatch, Defendant immediately instructed counsel to seek relief from the default." Mot. at 2. And there is no indication that setting aside the Default will cause Plaintiffs any prejudice. See Sherrard, 724 F. App'x at 738-739 (setting aside default where there was no indication that a "brief delay" would cause prejudice such as "a loss of evidence," "increased difficulties in discovery," or "opportunities for fraud or collusion."). Accordingly, the Court finds good cause under Federal Rule of Civil Procedure 55(c) to set aside the Clerk's Entry of Default as to Defendant Lingmou (Rapsaur). The Order instructed the Parties to confer and further stated that, "If the Parties determine that the relief requested in the Motion is no longer warranted, then they will file a joint notice by no later than Friday, May 8, 2026. Upon the filing of such a notice, the Court will cancel the hearing." (Id.) (original emphasis omitted; italics emphasis added). Meaning, if a severance was no longer warranted, then the Court would cancel the May 15th hearing. On May 8, 2026, the Parties filed their Joint Notice, stating that the Parties had conferred and agree that no hearing is necessary on Defendants' Motion to Sever (ECF No. 80). The Plaintiffs and Glacier Defendants agree that the litigation against the Glacier Defendants can be severed to a new case number, and should include all pleadings filings and rulings regarding the Glacier Defendants. Accordingly, Plaintiffs and Glacier Defendants believe that the Court can cancel the May 15 hearing, and look forward to any further instructions or questions from the Court on this issue.(ECF No. 297). Thus, the Parties' Joint Notice indicated both that they agree to the severance (i.e., that the relief requested in the Motion was still warranted) and that the Parties believed that the May 15th hearing could be canceled. The Court envisioned cancelling the hearing if the Parties agreed that the relief requested in the Motion (the requested severance) was no longer warranted. But, because the Parties agree that a severance is still warranted, it will be helpful to the Court to hold the hearing to discuss the logistics of the proposed severance. Accordingly, the May 15th Zoom hearing will proceed as scheduled. The Parties' will utilize the Zoom link/meeting information in ECF No. 290. The Parties should be prepared to discuss which Defendants are still left in the case and how the Glacier Defendants are differently-postured (procedurally) from the other Defendants. PAPERLESS ORDER Denying Defendants' [154] Motion for Leave to Deposit Funds Into Court Registry. Defendants seek leave to deposit a bond of five-thousand dollars with the Court Registry. Defendants have not argued the purpose or propriety of their Motion and did not attach a memorandum of law to their Motion. Rule 67 provides that "[i]f any part of the relief sought is a money judgment or the disposition of a sum of money., a party. may deposit with the court all or part of the money." Fed. R. Civ. P. 67(a). "The core purpose of Rule 67 is 'to relieve the depositor of responsibility for a fund in dispute, such as in an interpleader action.'" See Klayman v. Judicial Watch, Inc., 650 F. App'x 741, 743 (11th Cir. 2016) (quoting Gulf States Utils. Co. v. Ala. Power Co., 824 F.2d 1465, 1474 (5th Cir. 1987)); see also White Surf Condo. Management Association, Inc. v. Lexington Ins. Co., No. 617CV1203, 2018 WL 11652211, at *1 (M.D. Fla. Oct. 31, 2018) (denying motion to deposit funds, reasoning that an interpleader action represented the usual use of Rule 67, and explaining "there does not appear to be a unique fund in dispute - either [defendant] owes money to Plaintiff or it does not."). This action is not an interpleader action and, thus far, only the Plaintiffs acting together seek compensatory damages. While Plaintiffs may be awarded compensatory damages - depending on the outcome of the litigation - those damages are yet to be determined, meaning there is no discrete fund in dispute.
