PAPERLESS ORDER granting 98 Defendant BKPPM's Unopposed Motion to Set Aside Clerk's Entry of Default and requiring Informal Settlement Conference. On June 24, 2026, the Clerk of Court entered a Clerk's Default against a subset of Defendants who failed to answer Plaintiffs' Complaint. See [ECF No. 79]. On July 12, 2026, Defendant BKPPM filed a Motion to Set Aside Clerk's Entry of Default ("Motion"), [ECF No. 98].The Court "may set aside an entry of default for good cause." Fed. R. Civ. P. 55(c). Although good cause is "not susceptible to a precise formula," Courts may consider factors including "whether the default was culpable or willful, whether setting it aside would prejudice the adversary,...whether the defaulting party presents a meritorious defense[, and] whether the defaulting party acted promptly to correct the default." Sherrard v. Macy's Sys. & Tech. Inc., 724 F. App'x 736, 738 (11th Cir. 2018) (cleaned up). The Eleventh Circuit has made clear that defaults are disfavored given the "strong policy of determining cases on their merits." Id. (quoting In re Worldwide Web Sys., Inc., 328 F.3d 1291, 1295 (11th Cir. 2003)).Here, Defendant BKPPM has represented credibly that the default was not willful or culpable because "[a]ny delay in responding was occasioned by the time required to confirm and engage counsel qualified to appear on BKPPM's behalf in this District" and "[o]nce that engagement was confirmed, undersigned counsel appeared...just fourteen days after entry of default." Mot. at 4. And there is no indication that setting aside the Default will cause Plaintiffs any prejudice, as this case remains in its early stages. Mot. at 5; cf. Sherrard, 724 F. App'x at 738-739 (setting aside default where there was no indication that a "brief delay" would cause prejudice such as "a loss of evidence," "increased difficulties in discovery," or "opportunities for fraud or collusion."). Accordingly, the Court finds good cause under Federal Rule of Civil Procedure 55(c) to set aside the Clerk's Entry of Default as to Defendant BKPPM. The Clerk's Entry of Default as to BKPPM, [ECF No. 79], is hereby VACATED.Moreover, Plaintiffs shall conduct an informal settlement conference for a minimum of two (2) hours with Defendant BKPPM to determine if this action can be resolved as to this Defendant. A representative with settlement authority must be available telephonically. The parties shall file a Joint Notice of Compliance and Status Report certifying compliance with this Order and providing a report on the status of discussions on or before 5:00 P.M. on August 3, 2026. If the parties are unable to resolve this action as to Defendant BKPPM, Defendant BKPPM shall respond to Plaintiffs' Complaint no later than fourteen (14) days after the parties file their Joint Notice of Compliance with this Order. Therefore, by Friday, June 19, 2026, the Yu Defendants will re-file Exhibit 1 in the form of a memorandum of law with a case caption. The undersigned will require that this memorandum be double spaced and in 12-point font. Plaintiffs may file a five-page response memorandum limited to addressing the issue of invalidity by no later than Thursday, June 25, 2026. No reply will be permitted. The instant Motion highlights what appears to be an agreement by the parties on the need to set an evidentiary hearing on the 58 Preliminary Injunction Motion.
