EO: The Court reviewed [8] Non-Party Charles Muszynski's Motion for Leave to File an Amicus Curiae Brief (Motion). A non-party has no right to file an amicus curiae brief in a pending action. See Flour Corp. v. U.S., 35 Fed. Cl. 284, 285 (1996). Rather, the decision is wholly within the court's discretion. See id. ("There is no right to file an amicus brief in this court; the decision whether to allow participation by amici curiae is left entirely to the discretion of the court.") (citation omitted). The Court may deny leave to file an amicus curiae brief if the information offered is not timely or useful. See, e.g., Long v. Coast Resorts, Inc., 49 F. Supp. 2d 1177, 1178 (D. Nev. 1999). Upon review of the proposed amicus curiae brief, which is attached as Exhibit A to the Motion, the Court finds that the information offered therein is not useful at this stage of the proceedings. As such, Non-Party Charles Muszynski's Motion, ECF No. [8] is DENIED without prejudice.
