MINUTE entry before the Honorable Franklin U. Valderrama: The Court grants Plaintiff's unopposed motion for leave to serve subpoena on third parties under Rule 45 37 . When addressing this type of motion, courts consider whether good cause exists: "(1) the concreteness of the plaintiff's showing of a prima facie claim of actionable harm,... (2) the specificity of the discovery request,... (3) the absence of alternative means to obtain the subpoenaed information,... (4) the need for the subpoenaed information to advance the claim,... and (5) the objecting party's expectation of privacy." Malibu Media, LLC v. Doe, No. 18 C 5792, 2019 WL 7876473, at *2 (N.D. Ill. Jan. 2, 2019) (quoting Arista Records, LLC v. Doe 3, 604 F.3d 110, 118-19 (2d Cir. 2010)). These factors weigh in favor of allowing Plaintiff's requested expedited discovery, as Plaintiff has made a prima facie case of patent infringement, seeks limited and specific information, lacks alternative means to identify the Defendants, and the Defendants' identity is necessary to proceed with this litigation. The Defendants have at least a minimal privacy interest in the identity information associated with the Seller IDs, but this interest can be protected by keeping such information under seal through at least the early stages of discovery until enough evidence can be marshaled to show that a particular person (or persons) is tied to the alleged infringement. Altogether, these factors weigh in favor of granting the motion, and good cause exists to do so. The motion 37 is therefore granted, and Plaintiff may serve a third-party subpoena on Amazon, eBay, and Walmart seeking identifying information as well as sales information on the accused products sold by Defendants and identified by Plaintiff associated with Defendants' Seller IDs. See id. at *2-3; Cobbler Nevada, LLC v. Does 1-28, No. 15 C 7538, 2016 WL 193408, at *2-4 (N.D. Ill. Jan. 15, 2016). Plaintiff, however, may not publish the identities of the Defendants in any way without further leave of court, and Defendants may proceed in this case by pseudonym until further order from the court. This order is without prejudice to the Defendants. In lieu of an initial status report, by 7/9/24 Plaintiff shall file a status report confirming service of the subpoena, stating the status of the production, and indicating whether Plaintiff has obtained the information necessary to file an amended complaint naming the proper Defendant. Valderrama: For the reasons stated in the motions, the Court grants Plaintiff's ex parte motion for a temporary restraining order and alternate service of process 16, motion to seal certain documents 14, and motion to file excess pages 15 . Provided that Plaintiff provides the security described in paragraph 13 of the temporary restraining order, the temporary restraining order shall become effective on 4/19/2024 at 6:00 p.m. and shall expire in fourteen (14) days from the effective date. MINUTE entry before the Honorable Franklin U. Valderrama: The Court is in receipt of Plaintiff's Motion to Seal Certain Documents and Proceed Temporarily Under Pseudonym 3, Plaintiff's Motion to File Excess Pages 9, and Plaintiff's Motion for Temporary Restraining Order and Alternative Service of Process 10 . As an initial matter, the Seventh Circuit has "repeatedly voiced [its] disfavor of parties proceeding anonymously, as anonymous litigation runs contrary to the rights of the public to have open judicial proceedings and to know who is using court facilities and procedures funded by public taxes. To proceed anonymously, a party must demonstrate 'exceptional circumstances' that outweigh both the public policy in favor of identified parties and the prejudice to the opposing party that would result from anonymity." Doe v. Vill. of Deerfield, 819 F.3d 372, 37677 (7th Cir. 2016) (citation omitted); see also Doe v. Smith, 429 F.3d 706, 710 (7th Cir. 2005) ("[T]his circuit's decisions... disfavor anonymous litigation."); Doe v. Blue Cross & Blue Shield United of Wis., 112 F.3d 869, 872 (7th Cir. 1997) ("Identifying the parties to the proceeding is an important dimension of publicness. The people have a right to know who is using their courts."). The Court cannot see how this Schedule A plaintiff meets the "exceptional circumstances" requirement as outlined by the Seventh Circuit. Even so, "[t]o permit pseudonymity/anonymity here, while many other Schedule A plaintiffs proceed under their actual names, would threaten to allow the exception of 'exceptional circumstances' to swallow the general rule barring pseudonymity." XYZ Corp. v. Partnerships & Unincorporated Associations Identified on Schedule A, 2022 WL 180151, at *2 (N.D. Ill. Jan. 20, 2022). The presently sealed documents will, however, remain under provisional seal until further order to permit Plaintiff the opportunity to decide how it wishes to proceed with this case. On or before 04/16/2024, Plaintiff must either file an amended complaint that lists Plaintiff's true name or file a stipulation of dismissal. If Plaintiff files an amended complaint, Plaintiff must file a new motion for leave to file certain documents under seal, a new motion for electronic service of process, a new motion for excess pages, and a new Ex Parte motion for entry of a temporary restraining order.
