MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion for leave to file under seal and temporarily proceed under a pseudonym 5 and plaintiff's motion for electronic service of process 12 are both granted. Plaintiff's motion for entry of an ex parte motion for temporary restraining order 10 is denied without prejudice to refiling. The plaintiff in this case has sued 688 defendants for copyright infringement. All of the defendants are alleged to be online sellers selling the same or closely similar "knock-off" products allegedly using the plaintiff's copyrighted material. The plaintiff has moved ex parte for entry of a temporary restraining order barring infringement and freezing assets. The Court has in the past raised questions regarding the joinder of this many defendants in a single case for which the plaintiff has paid a single filing fee. It has become common in this district for plaintiffs in similar cases to sue large numbers of defendants in a single case, but the norm tends to be somewhere between 100 and 250. The plaintiff alleges on information and belief that it is likely that a significant number of the defendants are acting in concert or are interrelated but, for good reason, stops short of saying this is so for all 688. The Court does not find at this point that the claims against the defendants fail to meet the "same transaction, occurrence, or series of transactions or occurrences" requirement for joinder under Fed. R. Civ. P. 20(a), but the sheer number of defendants sued gives rise to a significant concern regarding the unwieldiness of the lawsuit and the burden imposed. The Court therefore exercises its discretion under Fed. R. Civ. P. 20, 21, and 42(b) to limit the plaintiff to no more than 250 defendants in this lawsuit. The plaintiff need not dismiss the lawsuit in its entirety but may instead voluntarily dismiss without prejudice its claims against the defendants that exceed that number and name them in separate lawsuits. The Court has denied without prejudice the plaintiff's motion for entry of an ex parte temporary restraining order, but the plaintiff may refile that motion once the case is resized.
