188 条记录DEFAULT JUDGMENT. The plaintiff's motion for default judgment [176] is granted. The Court awards the plaintiff statutory damages of $1,500 as to each defendant based on the defendants' willful infringement. The plaintiff failed to present any evidence related to the value of the infringed copyright, such as revenue from sales or licensing, expert valuations, or the volume of the defendants' sales. Without such evidence, the plaintiff has not shown any entitlement to anything above the statutory minimum, which the Court has doubled to account for the defendants' willful infringement. Instead of evidence concerning the value of the infringed copyright, the plaintiff relied on three arguments that were not persuasive. The plaintiff claimed that the defendants engaged in deceptive and unethical business practices by "designing the product listings of the infringing products so that they appear to be selling genuine versions" of the copyrighted work. This argument fails for several reasons. First, it is too generalized to apply to all of the defaulting defendants. The plaintiff needs to substantiate this claim as to each defendant. Second, the nature of copyright infringement is copying. So it is not surprising that a copy of the genuine version would look like the genuine version. The plaintiff claims that the defendants' use of the internet to infringe warrants a high statutory damages award. The plaintiff makes no effort to tie the cited cases to the facts of this case. And, again, the plaintiff does nothing to substantiate its claim that the defendants' use of "the internet. had a pervasive impact on the market for the plaintiff's copyrighted work." And the Court sees no reason to increase the statutory damages amount based on the defendants' "decision to ignore this action." Not only does this argument assume the defendants received notice and had the means to defend against this action that, if the plaintiff's allegations are true, took place in another country, it also attempts to stretch the default judgment beyond its intended use. The plaintiff wins because the defendants failed to defend. The plaintiff does not get increased damages simply because the defendants failed to defend. Civil case terminated. MINUTE entry before the Honorable Jeremy C. Daniel: Defendant Gibelle's and Mitovilla's motion for reassignment and consolidation 133 is denied. These defendants seek to consolidate cases brought by the plaintiff against them asserting various copyrights. While the cases are of the same ilk, they involve different copyrights and accused products, each of which have issues of law (e.g. whether each copyright is valid) and fact (e.g. whether each accused product infringes the copyright). Therefore, the Court finds that reassignment and consolidation are not appropriate. Mailed notice.
MINUTE entry before the Honorable Jeremy C. Daniel: The plaintiff's motion to stay pending interlocutory appeal 144 is denied. In dissolving the preliminary injunction previously entered in this case, the Court held that "There is no evidence in the record of any creativity on the photographer's part. At this point, the record does not establish the necessary originality to warrant copyright protection. As a result, the plaintiff has not shown a likelihood of success on the merits with respect to the first element of his copyright infringement claim." (R. 96 at 3.) That is the issue on appeal, whether the plaintiff met its burden of showing a likelihood of success on the merits. Contrary to the plaintiff's assertion, the Court did not find the asserted copyright invalid. Rather, the Court's order left open whether the plaintiff could come forward with sufficient evidence to establish that the asserted work is copyrightable. (See R. 96 at 3 ("On the one hand, you have the photographer's generic claims concerning his artistic and technical choices. Those claims do not explain what decisions, if any, he made concerning framing, perspective, lighting, angle, shading, or focus.").) The Court sees no reason to delay the parties' efforts to develop the record and work toward a decision on the merits. The parties shall file a status report on or before April 11, 2025, that addresses the status of the pleadings, identifies any pending motions, proposes a discovery schedule, and identifies any issues that require the Court's attention. The status report should also address the anticipated length or trial and the parties' availability for trial in the first half of 2026. Mailed notice.
