#38

MINUTE entry before the Honorable Steven C. Seeger: The Court reviewed Plaintiff's motion for default judgment. (Dckt. No. [33]) The Court previously entered default against all Defendants that did not receive an extension of time to answer the complaint. (Dckt. No. [32]) Since then, Plaintiff voluntarily dismissed some Defendants. (Dckt. No. [37]) For all remaining Defendants who are in default, the Court reaffirms its deadline for a response. Defendants have two weeks to respond to the motion for default judgment. Defendants moved for default judgment on May 15, 2025. So all remaining Defendants who are in default must file a response to the motion by May 29, 2025. A failure to comply will lead to appropriate relief, including the entry of final judgment. The Court directs the parties to engage in good faith, energetic settlement discussions. Plaintiff must serve a copy of this order and file a certificate of service. Mailed notice.

MINUTE entry before the Honorable Steven C. Seeger: On May 6, 2025, this Court issued an order directing Plaintiff to move for the entry of default and default judgment by May 11, 2025. (Dckt. No. [26]) Some Defendants moved for more time, and this Court granted that request, and gave them an extension to answer the complaint by May 16, 2025. (Dckt. No. [29]) By the look of things, some but not all of the Defendants requested and received more time. If that's right, then those Defendants did not meet this Court's deadline. And Plaintiff didn't meet this Court's deadline for a motion for default as to those Defendants, either. The Court sua sponte enters default under Rule 55(a) against all Defendants except those who received an extension (Dckt. Nos. [28], [29]) and except for the Defendants who were later dismissed (Dckt. No. [31]). The Court directs Plaintiff to file an updated Schedule A that clearly identifies which Defendants received an extension, and which Defendants are in default. A motion for default judgment as to those Defendants is due by May 19, 2025. A response is due two weeks later. A failure to comply will lead to appropriate relief, including dismissal or the entry of judgment. Plaintiff must serve a copy of this order and file a certificate of service. All parties must meet all deadlines. Mailed notice.
