MINUTE entry before the Honorable Matthew F. Kennelly: This is a copyright infringement suit alleging unauthorized sales of products that are claimed to infringe plaintiff's registered copyrights in "Care Bears"-related material. The problem is that the complaint offers no description--none--of exactly what material (images? written material? or what?) the defendants are claimed to have infringed. The complaint says nothing about this, and the complaint's attachment, which lists a number of copyrights with a fairly general description, adds nothing of substance on this point. It appears, from the Court's review of the several hundred pages of materials attached to plaintiff's ex parte motion for temporary restraining order, that what is at issue are various images--a lot of different images. But there would be no way for any defendant to tell this from the complaint. A complaint is supposed to put the defendants on fair notice of what they are claimed to have done, and this one does not do so in the Court's view. It is no answer to this that the defendants could figure it out from the attachments to the TRO motion; a defendant should be able to determine from the plaintiff's complaint (and the attachments to the complaint) what it is claimed to have done. The Court therefore denies, without prejudice, plaintiff's motion for a TRO and its motion for electronic service, which are based on the less-than-adequate complaint. Any amended complaint filed by plaintiff has to include at least a description of the images (or other copyrighted material) the defendants are claimed to infringe, and preferable depictions of those images. The amended complaint need not break that down on a defendant-by-defendant basis; rather it may identify all the images (or other material) claimed to be infringed and allege, if true, that each defendant has copied or otherwise infringed one or more of those items. The Court will keep the upcoming status hearing pending just in case plaintiff has any questions about this order. (mk) (Entered: 05/15/2025)
