Plaintiff's motion is entered and continued as to the request for entry of a default judgment. Any objections to the motion for entry of default judgment are due by 7/17/25. If no objections are filed by that date, the Court will consider the motion unopposed. MINUTE entry before the Honorable LaShonda A. Hunt: Plaintiff's motion for electronic service [19] is granted. Electronic service of process does not violate any treaty and is consistent with due process because it is an effective way to communicate with online marketplace defendants. Enter Order Authorizing Electronic Service of Process. The Court notes that Plaintiff reports that it has received a verified business email address for Defendant (Dkt. [20] at 2), but that email address is not included in the motion, memorandum in support of the motion, or other supporting materials. Plaintiff must ensure that Defendant's email address is included on the summons submitted to the Court and in the affidavit of service. Motion hearing set for 6/10/25 [21] is stricken. MOTION by Plaintiff Rumored Inc. for Electronic Service of Process Pursuant to Fed.R.Civ.P. 4(f)(3)
ORDER AUTHORIZING EXPEDITED DISCOVERY Signed by the Honorable LaShonda A. Hunt on 5/9/2025. Mailed notice (gel,)
MINUTE entry before the Honorable LaShonda A. Hunt: Plaintiff's ex parte motion for leave to conduct expedited discovery and electronic service of process pursuant to Federal Rule of Civil Procedure 4(f)(3) [14] is granted in part and denied in part. Plaintiff is granted leave to conduct expedited discovery to the extent authorized in the attached order. Enter Order Authorizing Expedited Discovery. Plaintiff's motion for electronic service of process is denied without prejudice. Plaintiff seeks authorization to effectuate service of process by email and electronic publication but has not yet shown that it has a reliable email address at which it may reach Defendant. Any renewed motion must include these details. Motion hearing set for 5/13/25 [16] is stricken. Plaintiff is ordered to file a status report by 5/30/25 updating the Court on the progress of expedited discovery and proposed next steps in this case. Finally, counsel is admonished that documents may not be filed under seal without first complying with Local Rule 26.2. The Clerk is directed, forthwith, to unseal the document filed at [2] due to counsel's failure to comply with the Court's local rules and because Plaintiff has filed an amended schedule A [13] displaying the name of the lone remaining Defendant. Plaintiff therefore has not established exceptional circumstances that would provide any basis for sealing the names of associated defendants listed in its original schedule A [2]. See Union Oil Co. of Cal. v. Leavell>/i>, 220 F.3d 562, 567-68 (7th Cir. 2000) ("Many a litigant would prefer that the subject matter of a case. be kept from the curious (including its business rivals and customers), but the tradition that litigation is open to the public is of very long standing."). Because the Amended Schedule A lists only one DefendantYiyizouthe Clerk is directed to correct the docket and caption to reflect that Yiyizou is the only Defendant in this case. Mailed notice (gel,)
