MINUTE entry before the Honorable Jeffrey I Cummings: The Court has reviewed the parties' recent filings and orders as follows. Plaintiff Zhongyi Jiang has filed a notice of voluntary dismissal [31] as to Jiang's claims, which is self-executing under Rule 41(a)(1)(A)(i). Pursuant to that notice of plaintiff's claims against the defendants listed on Amended Schedule A [21-3] are dismissed without prejudice. Plaintiff's motion for TRO [23] is denied as moot. Within its discretion, plaintiff's counsel's motion to withdraw [32] is granted in light of counsel's representation that there has been a breakdown in the attorney-client relationship. Attorney Mingzi Ouyang is terminated as counsel for Zhongyi Jiang. Attorney Ouyang shall promptly provide a copy of this order to Zhongyi Jiang electronically and must file a certificate of service with the Court by 4/15/26. By 5/1/26, Zhongyi Jiang shall file either a pro se appearance or an appearance through newly retained counsel. Jiang is advised that failure to appear in this action may result in a default judgment. Defendants Eany-KK and Rai-Mee's request to dismiss plaintiff's claims is denied as moot in light of Jiang's voluntary dismissal, but defendants' motion for order of default and default judgment remain pending [28]. Briefing is stayed on that request pending further order of the Court. The previously set 3/16/26 tracking status hearing is stricken and reset to 5/18/26 at 9:00 a.m. (to track the case only, no appearance is required). Mailed notice.
