MINUTE entry before the Honorable Franklin U. Valderrama: Before the Court is Plaintiff's motion for default judgment against Defendant MPB [20]. Under Fed. R. Civ. P. 55, a party must first request entry of default under Rule 55(a) before moving for a default judgment under Rule 55(b). See Campbell v. City of Galesburg, 2024 WL 1345335, at *3 n.6 (C.D. Ill. Mar. 29, 2024) ("An entry of default, which has not been entered, is a prerequisite to default judgment."); see also In re Catt, 368 F.3d 789, 793 (7th Cir. 2004) ("There are two stages in a default proceeding: the establishment of the default, and the actual entry of a default judgment. Once the default is established, and thus liability, the plaintiff still must establish his entitlement to the relief he seeks."). Because Plaintiff's motion requests both entry of default and default judgment, at this time the Court grants Plaintiff's request for entry of default. [20]. Default is entered against Defendant under Federal Rule of Civil Procedure 55(a). The Court directs Plaintiff to mail a copy of this minute entry to Defendant at the service address no later than 8/1/2025 via USPS First Class Mail or a similar mailing service and to file a certificate of service on the docket. Plaintiff's request for default judgment against Defendant is entered and continued to 8/28/2025. The Court shall issue its ruling on Plaintiff's request for default judgment under Federal Rule of Civil Procedure 55(b) on or after 8/28/2025. Mailed notice.
