MINUTE entry before the Honorable Jeremy C. Daniel: The plaintiff failed to appear on its motion. The Court cautions the plaintiff that failure to appear at court hearings may result in dismissal for want of prosecution. The plaintiff's motion for electronic service of process and for an extension of time to serve the defendants [13] is granted in part and denied in part. The motion for electronic service of process is denied. The plaintiff argues that "Electronic service is appropriate and necessary in this case because foreign e-commerce store operators (such as Defendants) offering for sale products using infringing intellectual property typically: (1) provide false, misleading and/or incomplete names and physical address information to conceal their locations and avoid liability for their unlawful conduct; and (2) rely primarily on electronic communications to communicate with their third-party service providers and customers." This generalization says nothing about the defendants in this case. Further, nothing suggests that the plaintiff has attempted traditional service, which renders the preceding generalization speculative. The Court grants the plaintiff's motion for an extension of time. The plaintiff must serve the defendants on or before December 9, 2025. Mailed notice.
