For the reasons stated on the record, Plaintiff's motion for entry of a preliminary injunction [37] is granted. With respect to Defendant lovelyshoponline (David Jinawan), the Court notes that their opposition to the preliminary injunction is based on the fact that the only sales activity to Illinois consudmers was "a single test purchase executed by Plaintiff's own counsel to an Illinois address." Accordingly, they argue that they made no "bona fide sales" of the accused product to Illinois consumers. Contrary to Defendant lovelyshoponline's assertions, however, the Seventh Circuit previously has held that a federal court in Illinois can properly exercise personal jurisdiction over a foreign defendant that "established an online store, using a third-party retailer," "unequivocally asserted a willingness to ship goods to Illinois and established the capacity to do so," and fulfilled a test order by "shipping an infringing product to" Illinois. NBA Properties, Inc. v. HANWJH, 46 F.4th 614, 620 (7th Cir. 2022). In finding minimum contacts with the forum state, the Seventh Circuit rejected the defendant's contention that "a single transaction cannot be sufficient to establish jurisdiction," noting that such a "rigid numerical line" would flout the Supreme Court's warning against "[t]alismanic jurisdictional formulas." Id. at 62425 (quoting Burger King Corp. v. Rudzewicz, 471 U.S. 462, 485 (1985)). For this reason, Plaintiff has made a sufficient showing of personal jurisdiction over Defendant lovelyshoponline and the single test purchase is sufficient to support a preliminary injunction. Nonetheless, the preliminary injunctive relief should be tailored to the alleged conduct in this case and the equitable relief Plaintiff is entitled to seek. Thus, Defendant lovelyshoponline (David Jinawan) may file a motion to modify the scope of the asset restraint and other preliminary injunctive relief so that it is limited to sales related to the allegedly infringing image(s). Plaintiff shall submit an updated proposed order to chambers. Defendant lovelyshoponline's motion to dissolve the temporary restraining order [47] is denied.
