MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion for leave to file under seal 5 is granted. Plaintiff has also moved to permit electronic service of summons under the Seventh Circuit's Kangol decision. In support, plaintiff contends that physical addresses for the 4 defendants cannot be located. But plaintiff's supporting affidavit for this proposition (see dkt. 13-2) is an affidavit that almost entirely consists of generic, non-case-specific information regarding location of online sellers. In the Court's view, the only case-specific material in the affidavit is the following paragraph: "Despite reasonably diligent efforts, including review of seller communications, social media pages, websites, shipping information, and publicly available sources, and attempts to verify any identified address through the methodology described above, we were unable to ascertain and verify a physical address for service for any seller in this case." The problem is that this is not supported with any documentation regarding specific searches done for the particular defendants in this case. Thus the Court cannot say that plaintiff has done what is required and, as importantly, cannot satisfy itself that the necessary showing has been made. The motion for electronic service 12 is therefore denied, without prejudice to renewal. The Court sets the case for a telephonic status hearing on 8/5/2026 at 8:55 AM, using call-in number 650-479-3207, access code 2305-915-8729. Any renewed motion for electronic service is to be filed by 8/3/2026.
