PRELIMINARY INJUNCTION AND ORDER OF SEIZUREIT IS HEREBY ORDERED that Defendants, their agents, servants, employees, successors and assigns, and all persons, firms and corporations acting in concert with Defendants are preliminary enjoined and restrained from: (a) using the JELLY ROLL Trademarks or any colorable imitations thereof on or in connection with the sale, offering for sale, distribution or advertising of the Infringing Merchandise; (b) manufacturing, distributing, selling or holding for sale any Infringing Merchandise bearing or otherwise using the JELLY ROLL Trademarks; and (c) aiding, abetting, encouraging or inducing others to do any of the acts herein enjoined. AND IT IS FURTHER ORDERED that the $5,000.00 bond that was posted by Plaintiffs with respect to the Temporary Restraining Order is hereby continued to secure payment of such costs and damages not to exceed such sum as may be suffered or sustained by any party who is found to be wrongfully restrained hereunder; AND IT IS FURTHER ORDERED that any Defendant who is served with a copy of this Preliminary Injunction and who objects to the provisions hereof may submit his or her objection to this Court or otherwise move for relief from this Court, but no such objection should serve to suspend this Order or stay the terms hereof unless otherwise ordered by this Court. ORDER TO SHOW CAUSE ON MOTION FOR PRELIMINARY INJUNCTION WITH TEMPORARY RESTRAINING ORDER AND ORDER OF SEZIURE: IT IS HEREBY ORDERED THAT Defendants, Various John Does, Jane Does and ABC Companies, their true identities being unknown, show cause on the 1st day of October 2024 at 9am o'clock in Courtroom 14-B at the United States District Court for the Southern District of New York, 500 Pearl Street, New York, New York, why an order pursuant to Fed.R.Civ.P. 65 should not be entered granting Plaintiffs a preliminary injunction enjoining Defendants from manufacturing, distributing, selling or holding for sale and authorizing seizure of all clothing, jewelry, photographs, posters and other merchandise (collectively the "Infringing Merchandise") bearing the JELLY ROLL trademark, likeness and logos (collectively the "JELLY ROLL Trademarks"); As further set forth in this Order. AND IT IS FURTHER ORDERED that this Order is hereby conditioned upon Plaintiffs filing with the Clerk of this Court, an undertaking, a surety bond or a certified, cashiers or attorneys' check, credit card or cash in the amount of $5,000.00 Dollars no later than September 27, 2024 to secure payment of such costs and damages not to exceed such sum as may be suffered or sustained by any party who is found to be wrongfully restrained hereby; As further set forth in this Order.
