The Court GRANTS Plaintiff's motion for prejudgment attachment of the frozen funds. In light of that, the Court vacates that portion of the preliminary injunction order that froze the Appearing Defendants' assets and DENIES as moot the Appearing Defendants' motion to modify the preliminary injunction to reduce the amount of assets frozen. (The preliminary injunction order otherwise remains in full effect.) The $25,000 that Plaintiff posted as security for the temporary restraining order and preliminary injunction is hereby deemed to be an undertaking for the prejudgment attachment. See N.Y. C.P.L.R. § 6212(b); see also 180 Life Scis. Corp. v. Tyche Cap. LLC, 188 N.Y.S.3d 53, 55 (N.Y. App. Div. 1st Dept 2023); N.Y. Dist. Council of Carpenters Pension Fund v. KW Const., Inc., No. 07-CV-8008 (RJS), 2008 WL 2115225, at *6 (S.D.N.Y. May 16, 2008) (finding an undertaking of $50,000 to be appropriate where "plaintiffs seek to attach defendants' assets up to the amount of $1,114,185.18" (listing cases)). No later than April 29, 2026, Plaintiff shall submit a proposed Order consistent with this Memorandum Opinion and Order. The Clerk of Court is directed to terminate ECF Nos. 90 and 102. SO ORDERED. PRELIMINARY INJUNCTION ORDER1. The injunctive relief previously granted in the TRO shall remain in place through the pendency of this action, and issuing this Order is warranted under Federal Rule of Civil Procedure 65 and Section 34 of the Lanham Act. a) Accordingly, Defendants are hereby restrained and enjoined from engaging in any of the following acts or omissions pending the final hearing and determination of this action or until further order of the Court: i. Using the Gummibr Mark or any reproduction, counterfeit, copy or colorable imitation of the Plaintiff's mark in connection with the distribution, advertising, offer for sale and/or sale of merchandise that is not the genuine products of the Plaintiff; ii. passing off, inducing or enabling others to sell or pass off any Counterfeit Products as genuine products made and/or sold by the Plaintiff and as further set forth in this Order; Further, Defendants are hereby restrained and enjoined from engaging in any of the following acts or omissions pending the final hearing and determination of this action or until further order of the Court: i. As sufficient cause has been shown, the expedited discovery previously granted in the TRO shall remain in place through the pendency of this action, including that: a) In advance of the Fed. R. Civ. P. 26(f) conference, Plaintiff may serve interrogatories pursuant to Rules 26 and 33 of the Federal Rules of Civil Procedure as well as Local Civil Rule 33.3 of the Local Rules for the Southern and Eastern Districts of New York limited to the subjects of properly identifying: i) the Defendants, ii) their assets; iii) other parties involved in the manufacturing, supply and sale of the Counterfeit Products and iv) Defendants' sales of the Counterfeit Product. Defendants who are served with this Order shall provide written responses under oath to such interrogatories within fourteen (14) days of service to Plaintiff's counsel. b) In advance of the Fed. R. Civ. P. 26(f) conference, Plaintiff may serve requests for the production of documents pursuant to Fed. R. Civ. P. 26 and 34 limited to seeking documents relating to the subjects of: i) the full identification of the Defendants, ii) the location of their accounts and assets, iii) the identification of other parties involved in the manufacturing, supply and sale of the Counterfeit Products, and iv) Defendants' sales of the Counterfeit Products.
