ORDER OF DISMISSAL: The Court having been advised that all claims asserted herein have been settled in principle, it is ORDERED that the above-entitled action be and is hereby dismissed and discontinued without costs, and without prejudice to the right to reopen the action within thirty days of the date of this Order if the settlement is not consummated. To be clear, any application to reopen must be filed within thirty days of this Order; any application to reopen filed thereafter may be denied solely on that basis. Further, if the parties wish for the Court to retain jurisdiction for the purposes of enforcing any settlement agreement, they must submit the settlement agreement to the Court within the same thirty-day period to be so ordered by the Court. Unless the Court orders otherwise, the Court will not retain jurisdiction to enforce a settlement agreement unless it is made part of the public record. Any pending motions are moot. DEFAULT JUDGMENT ORDER: Accordingly, this Court orders that JUNAID MORTIMER's Motion for Entry of Final Judgment by Default is GRANTED as follows, that Defaulting Defendants are deemed in default, and that this Default Judgment is entered against Defaulting Defendants. Pursuant to 17 U.S.C. § 504(c), Mortimer is awarded statutory damages from each of the Defaulting Defendants in the amount of one hundred thousand dollars ($100,000.00) for willful use of infringing Mortimer's Copyrighted Works on products sold through at least the Defendant Internet Stores. This award shall apply to each distinct Defaulting Defendant only once. The FIVE THOUSAND DOLLAR ($5,000) bond posted by Mortimer is ordered to be released by the Clerk. This is a Default Judgment. JOINT STIPULATION TO MODIFY PRELIMINARY INJUNCTION ORDER: Defendant, RoseMi Limited, d/b/a ROSEMIA ("Defendant" or "ROSEMIA"), and Plaintiff JUNAID MORTIMER ("Plaintiff' or "MORTIMER," and collectively with Defendant as the "Parties") by and through their counsels, respectfully submits this stipulation to modify the Preliminary Injunction Order. In support, the Parties state: On November 12, 2025, the Plaintiff initiated this litigation against Defendant for copyright infringement. Dkt. 1. On December 12, 2025, Court granted Plaintiffs motion for preliminary injunction restraining Defendant's Amazon account and all the funds. Dkt. 24. The Parties are engaged in settlement discussions and making progress towards resolving this matter. In the interest of enabling the Parties to focus on negotiating a settlement, the Parties stipulate to modify the Section 8, 9 and 10 of the Preliminary Injunction Order as the following: 1. Defendant shall be preliminarily restrained and enjoined from transferring or disposing of in an amount of $125,000 in Defendant's Amazon account until further ordered by this Court. 2. Any Third Party Providers, including PayPal, Alipay, Alibaba, Ant Financial, Wish.com, and Amazon Pay, shall restrain and enjoin Defendant's Amazon account from transferring or disposing of $125,000 until further ordered by this Court. WHEREFORE, Plaintiff and Defendant, each by their undersigned counsel, stipulate and jointly move this Court to modify the Preliminary Injunction Order. The injunction if so modified. SO ORDERED. ORDER: Accordingly, this Court orders that: 1. Defendants, their officers, agents, servants, employees, attorneys, and all persons acting for, with, by, through, under, or in active concert with them be preliminarily enjoined and restrained from: a. From manufacturing, importing, advertising, promoting, offering to sell, selling, distributing, or transferring any products bearing or using the Works, other than those actually manufactured or distributed by Plaintiff; as further set forth in this Order. No funds restrained by this Order shall be transferred or surrendered by any Defendant, financial institution, payment processor, bank, escrow service, money transmitter, or marketplace website including but not limited to Amazon, PayPal, Stripe, and their related companies and affiliates for any purpose (other than pursuant to a chargeback made pursuant to their security interest in the funds) without further Order of this Court. No Defendant whose funds are restrained by this Order may transfer said funds in possession of any financial institution, payment processor, bank, escrow service, money transmitter, or marketplace website, including but not limited to Amazon, PayPal, Stripe, and their related companies and affiliates restrained by this Order to any other financial institution, payment processor, bank, escrow service, money transmitter or marketplace website without further Order of this Court. This Order shall apply to the Seller IDs, associated e-commerce stores and websites, and any other seller identification names, e-commerce stores, websites, or financial accounts which are being used by defendants for the purpose of counterfeiting and/or copying the Plaintiff's Works. This Order shall remain in effect during the pendency of this action or until further Court Order. Any Defendants that are subject to this Order may appear and move to dissolve or modify the Order as permitted by and in compliance with the Federal Rules of Civil Procedure and the Southern District of New York Local Rules. Any third party impacted by this Order may move for appropriate relief. ORDER GRANTING PLAINTIFF'S MOTION TO CONTINUE HEARING ON MOTION FOR PRELIMINARY INJUNCTION AND EXTEND TEMPORARY RESTRAINING ORDER granting [12] Motion to Continue. ORDER GRANTING EX PARTE APPLICATION FOR ENTRY OF TEMPORARY RESTRAINING ORDER: This matter is before the Court on Plaintiff's Ex Parte Application for Entry of Temporary Restraining Order and Order Restraining Transfer of Assets (ECF 6), filed under 17 U.S.C. §§ 502 and 503, Federal Rule of Civil Procedure 65, and The All Writs Act, 28 U.S.C. § 1651(a), by Plaintiff, Junaid Mortimer ("Plaintiff"). Plaintiff asks the Court to enter a Temporary Restraining Order and an order restraining the financial accounts used by Defendants. As discussed below, Plaintiff has satisfied the requirements for issuance of a temporary restraining order. As further stated in this Order, Accordingly, the Court, having considered the Motion, and having found good cause, it is ORDERED that the Motion is GRANTED, and a Temporary Restraining Order is entered as follows: TEMPORARY RESTRAINING ORDER Each Defendant, its officers, directors, employees, agents, subsidiaries, distributors, and all persons in active concert or participation with any Defendant having notice of this Order are hereby restrained and enjoined until further Order of this Court: a. From manufacturing, importing, advertising, promoting, offering to sell, selling, distributing, or transferring any products bearing or using Plaintiff's copyrights or substantially similar works, other than those actually manufactured or distributed by Plaintiff; and b. From secreting, concealing, destroying, selling off, transferring, or otherwise disposing of: (i) any products, not manufactured or distributed by Plaintiff, bearing and/or using Plaintiff's copyrights or substantially similar works; or (ii) any evidence relating to the manufacture, importation, sale, offer for sale, distribution, or transfer of any products bearing and/or using Plaintiff's copyrights or substantially similar works; or (iii) any assets or other financial accounts subject to this Order, including inventory assets, in the actual or constructive possession of, or owned, controlled, or held by, or subject to access by, any Defendant, including, but not limited to, any assets held by or on behalf of any Defendant; and c. From copying, displaying, distributing, or creating derivative works of Plaintiff's copyrights. As further stated in this Order, This Order shall remain in effect until fourteen (14) days from the date of this order, or until such further dates as set by the Court or stipulated by the parties.
