MEMO ENDORSEMENT on re: [19] Letter filed by WHAM-O Holding, LTD, Intersport Corp. ENDORSEMENT: Application DENIED. On May 1, 2026, Plaintiffs moved ex parte for a temporary restraining order in this trademark infringement case. ECF No. 8. On May 5, 2026, the Court requested "additional info1mation and authorities relating to the likelihood of success on the merits, specifically with respect to the strength of the mark in question and the likelihood of confusion." ECF No. 16. Plaintiffs did not provide any such info1mation or authorities. On June 4, 2026, the Court issued an order noting the same and directing Plaintiffs to file a letter updating the Court on the status of the matter. ECF No. 18. The Order provided that, if "Plaintiffs [were] not prepared to litigate this action at this time, they [ could] file a notice of volunta1y dismissal pursuant to Federal Rule of Civil Procedure 4l(a)(l)(A)(i) and commence a new action when they are ready to proceed." Id. Plaintiffs now state that they "intend" to file a supplemental memorandum and that they "anticipate" doing so "likely on or before June 19, 2026"-seven weeks after having initiated this action. ECF No. 19. If Plaintiffs require additional time to prepare this case, they may dismiss the action without prejudice to refiling when they are ready to do so. SO ORDERED.
