ORDER VACATING CLERK'S ENTRY OF DEFAULT 214 AND STRIKING REQUEST FOR CLERK'S ENTRY OF DEFAULT 213. The Plaintiff filed a Request for the Clerk to enter default against certain named Defendants as listed on an exhibit to the Request at 213. The Clerk entered such defaults, apparently in reliance on the accuracy of the submission by the Plaintiff as to the identity of Defendants in default. 214. As it turned out, it appears from an examination of the entries of appearance as reflected on the docket that a number of the Defendants listed on the Plaintiff's filing for entry of default could not be and are not in default, as they have defended by the filing of an answer or Motion under Fed. R. Civ. P. 12 or have otherwise appeared in this action. See Defendants Nos. 6, 16, 19, 21, 22, 24, 27, 32, 33, 36, 37, 41, 42, 46, 61, 64, 65, 70, 81, 84, 199, 203, 205, 223, for example as set out in 210. This has led to a flurry of communications to Chambers by counsel and parties seeking to learn why they or their clients have been defaulted. The Courts examination of the docket does not reveal any good reason, other than the almost certainty that when the Plaintiff by counsel filed its Request for Default, it made a number of mistakes in terms of listing of the Defendants arguably actually in default. The Clerk's entry of default 214 is therefore VACATED in its entirety, and the Request for Default 213 is STRICKEN. If the Plaintiff is seeking to pursue the entry of default, it has to start over, and most importantly, provide the Clerk with accurate information. Should such a series of apparent errors by Plaintiff occur again, the Court will start to consider the award of fees in favor of any Defendant that has to have counsel undo things on their behalf. The papers of record indicate that the Plaintiff asserts that there are 237 Defendants in the action. The Plaintiff has proffered what appear to be exemplars of alleged infringing products, with the depictions of such products buried (in the court's estimation) in advertisements/on-line postings/depictions of numerous products of each Defendant. None of the exemplars are organized or arranged by "Defendant number" corresponding to the Schedule A listing advanced by the Plaintiff, nor do they appear to be presented in any readily-apparent organized fashion, as opposed to what is essentially a blob of photographs of such allegedly infringing products, coupled with the US Patent asserted in the action with its included diagrams. And as noted above, there are 200+ such Defendants/allegedly infringing products. The Plaintiff seeks extraordinary relief. For the Court to consider the same, it is obligated to perform an item-by-item examination to assess, among other things, likelihood of success on the merits of the Plaintiff's claims.
