MOTION for Hearing to Set Date for Preliminary Injunction Hearing by Through the Lyns LLC.
ORDER: Pending before the Court is "Plaintiff's Unopposed Motion to Drop Settled Defendants Pursuant to Federal Rule of Civil Procedure 21" (Doc. No. 60, "Motion"), wherein Plaintiff requests that the Court dismiss with prejudice Defendant No. 126 (Lushan City Mozhela E-commerce Co., Ltd.); Defendant No. 132 (Tongxitt); and Defendant No. 143 (MIMIMAMKT) as parties to this action. (Id. at 1). Here, the Court has little difficulty concluding that the interests of justice support dropping the parties as requested, given its potential for increasing judicial efficiency in resolving this dispute, the absence of any objection, the earliness of the current stage of litigation, and the unlikelihood of any prejudice to these three Defendants or any other Defendants. Accordingly, the Motion (Doc. No. 60) is GRANTED. Because the Motion indicates that the claims brought by Plaintiff against Defendant No. 126 (Lushan City Mozhela E-commerce Co., Ltd.); Defendant No. 132 (Tongxitt); and Defendant No. 143 (MIMIMAMKT) are dismissed with prejudice, those claims are DISMISSED with prejudice, and the Clerk of the Court is DIRECTED to terminate each of these Defendants as defendants in this action. The claims between Plaintiff and the remaining Defendants remain pending. Signed by District Judge Eli J. Richardson on 7/10/2026. NOTICE by John Doe Regarding Mootness of Motions to Seal
ORDER: Rule 21 provides that the Court may at any time, on motion or on its own, add or drop a party or claim. Accordingly, the Motion (Doc. No. 39) is GRANTED. Because the Motion indicates that the claims brought by Plaintiff against Defendant No. 98 (LivialyCity), Defendant No. 116 (ASFHJP), Defendant No. 117 (Taizhou Huangyan Qianjing Co., Ltd.), Defendant No. 149 (Penguin Reads), and Defendant No. 156 (LIanManYuAI.XF) are dismissed with prejudice, those claims are DISMISSED with prejudice. Accordingly, the Clerk of the Court is DIRECTED to terminate Defendant No. 98 (LivialyCity), Defendant No. 116 (ASFHJP), Defendant No. 117 (Taizhou Huangyan Qianjing Co., Ltd.), Defendant No. 149 (Penguin Reads), and Defendant No. 156 (LIanManYuAI.XF) as defendants in this action. The claims between Plaintiff and the remaining Defendants remain pending. Signed by District Judge Eli J. Richardson on 6/4/2026. (DOCKET TEXT SUMMARY ONLY-ATTORNEYS MUST OPEN THE PDF AND READ THE ORDER.)
ORDER: Pending before the Court is "Plaintiff's Renewed Motion for Authorization of Alternative Service of Process and Memorandum of Law in Support" (Doc. No. 35, "Motion"). In support of the Motion, Plaintiff filed the declaration of G. Edward Powell III (Doc. No. 36). For the reasons provided herein, the Motion is granted in part and denied in part. Further, it is the Court's understanding that the motion to temporarily proceed under pseudonym and for leave to file certain documents under seal, (Doc. No. 7, "Motion to Proceed Under Pseudonym and to Seal"), and the supplemental motion to seal (Doc. No. 21, "Supplemental Motion to Seal") that are currently pending (hereinafter Doc. Nos. 7 and 21 are collectively referred to as the "Motions to Seal") are moot because Plaintiff is actively attempting to provide notice of the lawsuit and the relevant filings to the Defendants. Therefore, the Court is inclined to deny the Motions to Seal as moot, which would result in the unsealing of the sealed documents as well as the disclosure of Plaintiff's identity. Appreciating the sensitive nature of Plaintiff's identity and the filings currently under seal, the Court will afford Plaintiff three (3) days from the filing of this order to file a notice indicating whether (and if so why) the Motions to Seal are not moot; if Plaintiff does not persuade the Court that the Motions to Seal are not thus moot, the Court will deny the Motions to Seal as moot. Signed by District Judge Eli J. Richardson on 6/3/2026. (DOCKET TEXT SUMMARY ONLY-ATTORNEYS MUST OPEN THE PDF AND READ THE ORDER.)

ORDER: Pending before the Court is Plaintiff's "Notice of Voluntary Dismissal as to Defendant Nos. 76, 92, and 153" (Doc. No. 33, "Dismissal Document"), wherein Plaintiff requests that the Court dismiss all claims against three of the individual Defendants (Defendant No. 76, HOTREEN-US; Defendant No. 92, TICFICK (a/k/a ddxxxx); and Defendant No. 153, OCLUN) only. [T]he Court will construe the Dismissal Document as a motion under Rule 21 to drop specific parties (i.e., Defendant No. 76, HOTREEN-US; Defendant No. 92, TICFICK (a/k/a ddxxxx); and Defendant No. 153, OCLUN). Because the Dismissal Document indicates that the claims brought by Plaintiff against Defendant No. 76 (HOTREEN-US), Defendant No. 92 (TICFICK (a/k/a ddxxxx)), and Defendant No. 153 (OCLUN) are dismissed with prejudice, the claims brought by Plaintiff against Defendant No. 76 (HOTREEN-US), Defendant No. 92 (TICFICK (a/k/a ddxxxx)), and Defendant No. 153 (OCLUN) are DISMISSED with prejudice. Accordingly, the Clerk of the Court is DIRECTED to terminate Defendant No. 76 (HOTREEN-US), Defendant No. 92 (TICFICK (a/k/a ddxxxx)), and Defendant No. 153 (OCLUN) as defendants in this action. The claims between Plaintiff and the remaining Defendants remain pending. Importantly, the show cause hearing regarding Plaintiff's request for a preliminary injunction ("Preliminary Injunction Hearing") is set to be heard on Friday, May 29, 2026, at 9 a.m. (Doc. No. 32). Prior to the Preliminary Injunction Hearing, Plaintiff is DIRECTED to file a status update regarding which (if any) of the Defendants have been served, which (if any) of the Defendants are expected to appear at the Preliminary Injunction Hearing, and any other matter that Plaintiff deems pertinent in advance of the Preliminary Injunction Hearing. MEMORANDUM OPINION OF THE COURT For the reasons indicated herein, (i) the Motion for Temporary Restraining Order (Doc. No. 12) is hereby GRANTED in part and DENIED in part. To the extent that the Motion seeks expedited discovery, the Motion is granted consistent with the terms set forth above; to the extent that the Motion seeks authorization for alternative service of process, the Motion is denied without prejudice; and to the extent that the Motion requests a temporary restraining order, the Motion is granted in part and denied in part as will be reflected in a temporary restraining order to be entered separately; (ii) the Court will defer ruling on the Motions to Seal (Doc. Nos. 7 and 21) pending the filing of a notice from Plaintiff with its views regarding mootness, which is due three (3) days from the filing of this order; and (iii) the Motion to Strike (Doc. The Motion is denied to the extent that it requests leave to refile the Business Entity Disclosure Statement currently filed at Docket No. 9.
