ORDER re 44 Stipulation for Extension of Time to Answer by OLGA DROZDOVA, MRTLLOA. On 10/20/2025, Plaintiff Olga Drozdova and Defendant MRTLLOA filed a 44 Stipulation indicating that the parties agreed to a 15-day extension for the defendants to respond to Ms. Drozdova's complaint. ECF No. 2. Per Local Rule 7.E, the parties may file a stipulation one time to extend the deadline to file an answer or a Rule 12(b) motion, which the parties have already done. See ECF No. 41. Per the Court's 42 Order, the extended deadline to respond to the Complaint was 10/18/25. While Fed. R. Civ. P. 6(b)(1)(A), cited by the parties, permits the Court to extend time "with or without motion," that provision requires that the Court acts, or the request is made, "before the original time or its extension expires." The parties' stipulation here is untimely under Rule 6(b)(1)(A). As a one-time courtesy, however, the Court will treat the 44 Stipulation as a Motion for an Extension of Time to Answer the Complaint under Rule 6(b)(1)(B), which permits a motion to be made after the time has expired if the party failed to act because of excusable neglect. Given that Ms. Drozdova consents to the extension, IT IS HEREBY ORDERED that the request for additional time is GRANTED. Defendant MRTLLOA shall file a response to the complaint on or before 11/4/2025. No further extensions of this deadline will be granted absent extraordinary circumstances, and the parties are directed to follow the dictates of the Federal Rules of Procedure. ORDER GRANTING 40 Motion for Leave to File Stipulation for Extension of Time filed by Defendant MRTLLOA. On 9/12/2025, Plaintiff Olga Drozdova's counsel, Michael Mitchell, filed a Declaration of Service averring that service on Defendant MRRTLLOA was complete as of 8/28/2025. ECF No. 35. Accordingly, MRTLLOA's Answer was due on or before 9/18/2025. See Fed. R. Civ. P. 12(a)(1)(A)(i). MRTLLOA failed to timely file an Answer, and the Court issued an Order to Show Cause on 9/22/2025 directing Ms. Drozdova to show cause by 9/29/2025 as to why the action should not be dismissed for failure to prosecute as against MRTLLOA, or request an entry of default as against MRTLLOA. ECF No. 39. Also on 9/22/2025, MRTLLOA filed the instant 40 Motion seeking leave to file a stipulation extending MRTLLOA's time to respond to the Complaint. In the 40 Motion, MRTLLOA avers that it failed to timely respond to the Complaint due to a calendaring error, and that Ms. Drozdova has stipulated to a 30-day extension of time for MRTLLOA to respond. Indeed, MRTLLOA also filed a stipulation signed by Ms. Drozdova's counsel extending MRTLLOA's time to respond to 10/18/2025. ECF No. 41. Accordingly, IT IS HEREBY ORDERED that the 40 Motion is GRANTED. Because the parties' stipulated 30-day extension of MRTLLOA's time to respond to the Complaint is permitted by Local Civil Rule 7.E, MRTLLOA shall respond to the Complaint on or before 10/18/2025. ORDER DENYING 1 Motion to Seal Case and 3 Motion for Temporary Restraining Order filed by Plaintiff OLGA DROZDOVA. This is Ms. Drozdova's second case involving Defendant MRTLLOA that is pending before the undersigned. The first case is Drozdova v. 80SDESIGN, No. 25-cv-656 ("Drozdova I"). In that case, Ms. Drozdova asserted copyright infringement claims against 600 defendants, including MRTLLOA. See Drozdova I, ECF No. 2. In Drozdova I, the Court granted Ms. Drozdova's Motion to Seal the case, and Motion for a Temporary Restraining Order, which also included a motion to restrain assets and merchant storefronts, a motion for expedited discovery, and a motion for an order to show cause why a preliminary injunction should not issue against the defendants. See Drozdova I, ECF Nos. 14, 17. Ultimately, the Court declined to issue a preliminary injunction as against every defendant in Drozdova I except for one because the Court concluded that the 600 defendants in that case had been misjoined. Drozdova I, ECF No. 32. Thus, the Court subsequently dismissed without prejudice all but one defendant in Drozdova I. Drozdova I, ECF No. 48. MRTLLOA was among the dismissed defendants. Id. In the instant case, Ms. Drozdova has re-filed the same copyright infringement claim she asserted in Drozdova I against MRTLLOA only. See ECF No. 2. She has also filed a Motion to Seal this case and a Motion for a Temporary Restraining Order which are substantially identical to those she filed in Drozdova I. ECF Nos. 1, 3, 4. Because the rationale for sealing this case and issuing an ex parte temporary restraining order against MRTLLOA has lost its force, the Court declines to grant the 1 and 3 Motions. Specifically, the 3 Ex Parte Motion for a Temporary Restraining Order is premised on the fear that "[i]n the absence of a TRO without notice, [MRTLLOA] can and likely will register new ecommerce stores under new aliases and move any assets to offshore bank accounts outside the jurisdiction of this Court." ECF No. 4 at 6. Similarly, the 1 Motion to Seal contemplates that unless the Court seals this case until a temporary restraining order issues, MRTLLOA "will undoubtedly transfer and/or hide their assets rather than maintain them for discovery and recovery." In sum, the relief sought in the 1 and 3 Motions is based on the belief that swift action must be taken before MRTLLOA receives notice of these proceedings or else MRTLLOA will move its assets and cover its tracks. But MRTLLOA undoubtedly already knows of Ms. Drozova's claims and intention to pursue them because it was subjected to the temporary restraining order issued in Drozdova I, provided with notice in that case, and that case was later unsealed. See Drozdova I, ECF Nos. 17, 27, 33. Indeed, counsel for MRTLLOA appeared in Drozdova I. Drozdova I, ECF Nos. 45, 47. The Court therefore sees no reason why this case should be sealed, or why a temporary restraining order should issue on an ex parte basis. Moreover, Ms. Drozdova's request for expedited discovery that is included in her 3 Motion is similarly unwarranted given that Ms. Drozdova already had the opportunity to conduct expedited discovery against MRTLLOA in Drozdova I for the same claims asserted here. See Drozdova I, ECF No. 17. Finally, the Court declines to order MRTLLOA to show cause why a preliminary injunction should not issue given that the basis for the 3 Motion is undermined by MRTLLOA having notice of Ms. Drozdova's claims. Accordingly, for all of the foregoing reasons, IT IS HEREBY ORDERED that the 1 and 3 Motions are DENIED. The denial is without prejudice to Ms. Drozdova filing an appropriate motion for a preliminary injunction, with supporting materials, to the extent she believes specific injunctive relief is still warranted notwithstanding the fact that MRTLLOA has notice of her claims.
