ORDER DENYING WITHOUT PREJUDICE 33 Renewed Motion for Alternative Service filed by Plaintiff OLGA DROZDOVA. At the outset of this case, Ms. Drozdova filed a 5 Motion for Alternative Service seeking, in pertinent part, an order authorizing "service on Defendants' U.S Counsel Mingbo Ye." The Court denied that motion without prejudice because it felt it would not be proper "to authorize service through defense counsel who ha[d] not yet appeared in this case." ECF No. 22. In the 33 Motion, Ms. Drozdova renews her request to serve Defendants through Mingbo Ye because Ms. Ye "previously appeared on behalf of [the Defendants in this case]" in a related case on August 5, 2025, and "filed a motion for leave to file documents under seal on August 8, 2025, on behalf of the same Defendants" in that related case. According to Ms. Drozdova, "[t]hese appearances and filings clearly demonstrate the regularity of contact between the Defendants and Ms. Ye" such that service on Defendants through Ms. Ye is proper. ECF No. 33. Ms. Drozdova made the same argument in pursuing her initial 5 Motion for Alternative Service, and the Court again rejects it. The Court will not authorize service through counsel who has not appeared in this case. Accordingly, IT IS HEREBY ORDERED that the 33 Motion is DENIED WITHOUT PREJUDICE. IT IS FURTHER ORDERED that on or before 9/29/2025, Ms. Drozdova shall file a status report describing what efforts she is taking to serve the Defendants. ORDER DENYING WITHOUT PREJUDICE 5 Motion for Alternative Service. In the 5 Motion, Ms. Drozdova requests leave to serve Defendants via email and website publication, and/or to serve them by serving their counsel who is located in Texas. Ms. Drozdova avers that service on the attorney identified by Ms. Drozdova as Defendants counsel is proper because filings in other cases clearly show adequate and recent contact between Defendants and that attorney. The Court declines to authorize service through defense counsel who has not yet appeared in this case. As to Ms. Drozdovas request to serve Defendants via email and website publication, the Court declines to authorize service by such alternative means at this time. See SEC v. Lahr, No. 22-2497, 2024 WL 3518309, at *34 (3d Cir. July 24, 2024) (stating that where it applies, the Hague Convention is exclusive, and provides the relevant catalogue of possible means of transmission for service abroad, but noting that the Convention does not apply where the address of the party to be served is unknown and explaining that courts employ a reasonable diligence test that examines whether a plaintiff engaged in reasonably diligent efforts to discover a defendant's address). Accordingly, IT IS HEREBY ORDERED that the 5 Motion is DENIED WITHOUT PREJUDICE to Ms. Drozdovas ability to file a renewed motion for alternative service as appropriate. ORDER DENYING 1 Motion to Seal Case. This is Ms. Drozdova's second case before the undersigned involving the 19 Defendants named in this suit. The first case was Drozdova v. 80SDESIGN, No. 25-cv-656 ("Drozdova I"). In that case, Ms. Drozdova asserted copyright infringement claims against 600 defendants, including those named here. See Drozdova I, ECF No. 2. In Drozdova I, the Court granted Ms. Drozdova's Motion to Seal the case. See Drozdova I, ECF No. 14. Ultimately, the Court declined to issue a preliminary injunction as against every defendant in Drozdova I except for one because the Court concluded that the 600 defendants in that case had been misjoined. Drozdova I, ECF No. 32. Thus, the Court subsequently dismissed without prejudice all but one defendant in Drozdova I, including the Defendants named in the instant case. Drozdova I, ECF No. 48. Now, Ms. Drozdova has re-filed the same copyright infringement claim she asserted in Drozdova I against just 19 Defendants that were originally named in Drozdova I. See ECF No. 2. She has also filed a Motion to Seal this case which is substantially identical to the one she filed in Drozdova I. ECF No. 1. Because the rationale for sealing this case has lost its force, the Court declines to grant the 1 Motion. Specifically, the 1 Motion to Seal contemplates that unless the Court seals this case until a temporary restraining order issues, the Defendants "will undoubtedly transfer and/or hide their assets rather than maintain them for discovery and recovery." In sum, the relief sought in the 1 Motion is based on the belief that swift action must be taken before Defendants receive notice of these proceedings or else they will move their assets and cover their tracks. But Defendants undoubtedly already know of Ms. Drozova's claims and intention to pursue them because they were subjected to a temporary restraining order issued in Drozdova I, provided with notice in that case, and that case was later unsealed. See Drozdova I, ECF Nos. 17, 27, 33. Indeed, counsel for Defendants appeared in Drozdova I and filed a Motion on their behalf. Drozdova I, ECF Nos. 52, 53, 59. Because the Defendants are aware of Ms. Drozdovas claims and her intent to pursue them, the Court sees no reason why this case should be sealed. Accordingly, for all of the foregoing reasons, IT IS HEREBY ORDERED that the 1 Motion is DENIED. The Clerk of Court is directed to unseal this case.
