ORDER DENYING 1 Motion to Seal Case and 3 Motion for Temporary Restraining Order filed by Plaintiff OLGA DROZDOVA. This is Ms. Drozdova's second case involving Defendant zanlin that is pending before the undersigned. The first case is Drozdova v. 80SDESIGN, No. 25-cv-656 ("Drozdova I"). In that case, Ms. Drozdova asserted copyright infringement claims against 600 defendants, including zanlin. See Drozdova I, ECF No. 2. In Drozdova I, the Court granted Ms. Drozdova's Motion to Seal the case, and Motion for a Temporary Restraining Order, which also included a motion to restrain assets and merchant storefronts, a motion for expedited discovery, and a motion for an order to show cause why a preliminary injunction should not issue against the defendants. See Drozdova I, ECF Nos. 14, 17. Ultimately, the Court declined to issue a preliminary injunction as against every defendant in Drozdova I except for one because the Court concluded that the 600 defendants in that case had been misjoined. Drozdova I, ECF No. 32. Thus, the Court subsequently dismissed without prejudice all but one defendant in Drozdova I. Drozdova I, ECF No. 48. zanlin was among the dismissed defendants. Id. In the instant case, Ms. Drozdova has re-filed the same copyright infringement claim she asserted in Drozdova I against zanlin only. See ECF No. 2. She has also filed a Motion to Seal this case and a Motion for a Temporary Restraining Order which are substantially identical to those she filed in Drozdova I. ECF Nos. 1, 3, 4. Because the rationale for sealing this case and issuing an ex parte temporary restraining order against zanlin has lost its force, the Court declines to grant the 1 and 3 Motions. Specifically, the 3 Ex Parte Motion for a Temporary Restraining Order is premised on the fear that "[i]n the absence of a TRO without notice, [zanlin] can and likely will register new ecommerce stores under new aliases and move any assets to offshore bank accounts outside the jurisdiction of this Court." ECF No. 4 at 6. Similarly, the 1 Motion to Seal contemplates that unless the Court seals this case until a temporary restraining order issues, zanlin "will undoubtedly transfer and/or hide their assets rather than maintain them for discovery and recovery." In sum, the relief sought in the 1 and 3 Motions is based on the belief that swift action must be taken before zanlin receives notice of these proceedings or else zanlin will move its assets and cover its tracks. But zanlin undoubtedly already knows of Ms. Drozova's claims and intention to pursue them because it was subjected to the temporary restraining order issued in Drozdova I, provided with notice in that case, and that case was later unsealed. See Drozdova I, ECF Nos. 17, 27, 33. Indeed, counsel for zanlin appeared in Drozdova I, and zanlin filed an Answer. Drozdova I, ECF Nos. 34, 35, 38. The Court therefore sees no reason why this case should be sealed, or why a temporary restraining order should issue on an ex parte basis. Moreover, Ms. Drozdova's request for expedited discovery that is included in her 3 Motion is similarly unwarranted given that Ms. Drozdova already had the opportunity to conduct expedited discovery against zanlin in Drozdova I for the same claims asserted here. See Drozdova I, ECF No. 17. Finally, the Court declines to order zanlin to show cause why a preliminary injunction should not issue given that the basis for the 3 Motion is undermined by zanlin having notice of Ms. Drozdova's claims. Accordingly, for all of the foregoing reasons, IT IS HEREBY ORDERED that the 1 and 3 Motions are DENIED. The denial is without prejudice to Ms. Drozdova filing an appropriate motion for a preliminary injunction, with supporting materials, to the extent she believes specific injunctive relief is still warranted notwithstanding the fact that zanlin has notice of her claims.
